Most, if not all, divorce cases are referred to mediation if the parties have not reached a resolution on their own. Proponents of mediation often cite the parties’ ability to control and reach their own resolution as a benefit of mediation. Control over the outcome is especially important in family law where the alternative involves the Court decreeing an outcome which may leave one or both of the parties unhappy. Mediation provides the parties an opportunity to decide and control the outcome in their case.
