Michigan is considered a “no fault” divorce state. This means that a Court will grant a divorce to a party who seeks a divorce.  The Court does not ask for reasons why the parties are divorcing, and the divorce will be finalized as long as one spouse seeks the divorce.  Please click on the links below to learn more about the steps and stages of the process.

 Divorce with Minor Children

Under Michigan law, parties with children are required to attend several court hearings and wait a statutorily mandated 6 months prior to a divorce being finalized.  The parties often attend a hearing solely devoted to improving communication between the parties and the minor children.  The parties must resolve custody, parenting time, and support issues, along with division of property and assets, prior to the divorce being finalized.

Divorce with no Minor Children

In some cases where the marriage is brief in duration and the parties do not have minor children, a divorce can be finalized as soon as property, assets, and liabilities are divided.

In cases of a long term marriage with adult children, property division can be complicated due to the duration and complexity of issues such as property division, spousal support (alimony) and perhaps one party placing their career on hold while taking care of the household.
